2010 LAND ROVER EXPERIENCE WEEKEND CONTEST RULES

The Contest Period: The 2010 Land Rover Experience Weekend contest (the “Contest”) starts January 15, 2010 at 9:00 a.m. EST and ends April 18, 2010 at 9:00 p.m. EST (the “Contest Period”).
How to Enter: Enter the Contest in one of the following ways:
- WEB: Visit www.offroadexperience.ca and click on the 2010 Land Rover Experience Weekend Contest link. Complete all mandatory fields on the online Contest entry form, including name, address, and e-mail address, and submit the entry by clicking "Submit"; or
- KIOSK: Visit kiosks located at the Land Rover Booth at the following Canadian Auto Shows: Montreal (January 15, 2010 - January 24, 2010) and Toronto (February 12, 2010 - February 21, 2010) and complete all mandatory fields, including name, address and e-mail address on the Contest entry form and submit the entry by clicking "Submit".
Contest Eligibility: The Contest is open only to legal residents of Canada who, at the time of Contest entry, are 25 years of age or older and hold a valid Canadian driver's license. All employees (current and retired) of the Jaguar Land Rover ULC (“Land Rover Canada”) and all their Jaguar and Land Rover retailers, their advertising and promotional agencies, Contest judging organization, prize suppliers, and their parent, subsidiaries and affiliates, representatives, dealers and agents (together, the "Contest Sponsors") and those with whom they are domiciled are not eligible to enter the Contest. All entries must be received during the Contest Period in order to be considered valid. Limit of one (1) entry per person during the Contest Period regardless of the mode of entry (kiosk or web). If it is discovered that you attempted to enter more than once, all your entries will be void. In the event of a dispute regarding who submitted an entry, the entry will be deemed submitted by the authorized account holder of the e-mail address in question. Authorized account holder is the natural person who is assigned to an e-mail address by an internet service provider or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address in question. Potential winners may be required to show proof of being the authorized account holder.
Prize: There will be one (1) grand prize and two (2) secondary prizes awarded in Canada.
Grand Prize
The grand prize (the "Grand Prize") will consist of:
- Round Trip economy airfare for the Grand Prize winner and one (1) guest (together, the "Guests"), both of whom have signed a Consent, leaving from the same gateway and on the same itinerary from the Canadian International airport closest to winner's home (e.g. Vancouver, Calgary, Edmonton, Regina, Winnipeg, Toronto, Halifax or St. John's) to Montreal, Quebec. In the event the Grand Prize winner lives within 200km of Montreal’s borders, no airfare will be awarded. The chosen guest must be 25 years of age or older in order to participate.
- Pick-up for the Guests from the Montreal airport and drop-off at the Fairmont Le Château Montebello upon arrival in and departure from Montreal, Quebec. In the event the Grand Prize winner lives within 200km of Montreal’s borders, return ground transportation for the Guests from the Grand Prize winner’s home to the Fairmont Le Château Montebello will be provided.
- Two (2) nights hotel accommodation at Fairmont Le Château Montebello based on double occupancy.
- One (1) Land Rover Experience Driving School four (4) hour session for the Guests, consisting of a two (2) hour lesson and a two (2) hour trail ride at the Land Rover Experience Driving School, located at Fairmont Le Château Montebello. The Guests must be 25 years of age or older and hold a valid driver’s license in order to participate.
- One (1) $300 gift certificate for use by the Guests at the Fairmont Le Chateau Montebello hotel during the Guests' stay as part of the Grand Prize. (Gift certificate must be used during their stay at the Fairmont Le Château Montebello and cannot be used during any future trip. Any unused portion of the gift certificate is not redeemable for cash. Any and all terms and conditions of a Fairmont Gift Certificate apply.)
The approximate retail value of the Grand Prize is $5,000.00 CDN based on Vancouver departure from Vancouver airport. Actual value will vary depending on location of the winner's residence. Trip must be taken by December 31, 2010 and is subject to flight and hotel availability, blackout periods apply. Grand Prize may not be exactly as shown in Contest publicity or promotional materials. The Guests are responsible for obtaining any necessary and applicable travel and insurance documentation before the date of departure. The Guests must satisfy all conditions outlined in these rules and the Land Rover Experience Driving School Terms and Conditions including without limitation, holding a valid driver's license and insurance in order to be eligible to participate in the Grand Prize. The Guests will be solely responsible for all other incidental costs and expenses related to the Grand Prize not mentioned above, including, but without limitation, additional transportation to and from the residence(s) of the Guests and the Canadian International airport (both upon departure to Montreal and arrival after the conclusion of the trip), additional ground transportation, any applicable departure taxes, transportation taxes, shipping costs associated with the Grand Prize, travel, repatriation and health or travel insurance (collectively, "Insurance"), personal expenses, gratuities, meals, entertainment, etc. The Grand Prize winner may be required by Fairmont Le Château Montebello to provide an accepted and valid credit card to cover incidental charges (including but not limited to: telephone charges, laundry services, room service, etc.).
Secondary Prizes (Canadian Auto Show Kiosk Entry Only)
There will be two (2) secondary prizes awarded (each a “Secondary Prize”), each consisting of:
- one (1) pair of Nordica Speedmachine or Hot Rod model skis with binding from the 2009/2010 collection (to be supplied by Nordica Canada); and
- one (1) pair of Nordica Speedmachine or Hot Rod model boots from the 2009/2010 collection (to be supplied by Nordica Canada).
The approximate retail value of each Secondary Prize is $1,500 CDN. If the Secondary Prize winners require (as per their level of ability and needs) a product with a lower level of performance and request such product, Nordica Canada may agree to substitute, at their sole discretion, a different model depending on availability. Where Nordica Canada agrees to substitute the Secondary Prize for a product with a lower level of performance then no cash refund will be given for the difference in the retail value. Secondary Prizes may not be exactly as shown in Contest publicity or promotional materials. All incidental costs and expenses not specifically referred to as included shall be the sole responsibility of the winner.
Random Draw: All draws will be conducted by Trapeze (the "Contest Judges") in Toronto, Ontario on Thursday, April 22, 2010 at 9:00 a.m. Two (2) eligible Secondary Prize winners will be selected by random draw from among all eligible entries submitted during the Contest Period through both Contest entry methods. The two (2) entrants selected as eligible Secondary Prize winners will be reentered amongst the entries from which the Grand Prize winner will be drawn.
One (1) eligible Grand Prize winner will be selected by the Contest Judges via random draw from among all eligible entries received during the Contest Period through both Contest entry methods. The drawing for the Grand Prize will immediately follow the Secondary Prize draw described above.
Eligible winners will be contacted by phone or e-mail within 48 hours of the draw. If a selected entrant cannot be contacted within 14 days of the draw or, if contacted, does not claim his or her prize on or before such date and time, or does not meet all of the Contest conditions outlined in these rules, another entry may be selected from among all remaining eligible entries.
Chances of winning a prize are solely dependent on the total number of eligible entries received during the Contest Period.
Winners’ names will be available on the Contest website no later than April 22nd, 2010 when the identities of the winners are confirmed. Winners will consent to have their names published.
Prize Substitution: The prizes and prize portions are non-exchangeable, non-transferable, non-refundable, have no cash surrender value and must be accepted as awarded with no substitutions. Any unused portions of the prizes will be forfeited and will have no cash value. Contest Sponsors and prize suppliers reserve the rights, at their sole discretion, to substitute a prize or prize portion awarded with (a) prize(s) of equivalent or greater value for any reason.
General Conditions: To win, a selected entrant must first have complied with these rules and correctly answered, unaided, a time-limited skill-testing question to be administered by e-mail or telephone by the Contest Judges at a prearranged mutually convenient time. Successful entrants will be instructed on how to claim his/her prizes. Selected entrants and any guest of the Grand Prize winner will be required to sign a standard release form confirming compliance with and agreement to be bound by these Contest rules and releasing the Contest Sponsors, their directors, officers, dealers, partners and employees from any and all liability arising from the acceptance of a prize or prize portion as awarded. All decisions of the Contest Judges are final. This Contest is subject to all Federal, Provincial and Municipal laws. Void where prohibited.
Publicity: By entering the Contest, each entrant agrees to be bound by these rules and the decisions of the Contest Judges, and consents to the use of their name, city of residence, likeness, photograph, image and voice without payment or compensation, in any publicity or advertising in any medium carried out by Contest Sponsors. All entries become the property of Land Rover Canada and will not be returned. Any guest of the Grand Prize winner will be required to sign a publicity release consenting to the use of their name, city of residence, likeness, photograph, image and voice without payment or compensation, in any publicity or advertising in any medium carried out by Contest Sponsors.
Termination: Subject to applicable law and the approval of the Régie des alcools, des courses et des jeux in Quebec, Contest Sponsors reserve the right to amend, cancel, terminate or suspend this Contest in whole or in part if for any reason the Contest cannot run as planned, including but not limited to, technical failure, or computer virus, tampering, fraud, or corruption of security or proper administration of the Contest without prior notice. In such event, a winner may be selected by randomly drawing from among all valid entries received up to such time of cancellation, termination or suspension.
Quebec: For Quebec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
Liability: Contest Sponsors, their directors, officers, partners, dealers and employees shall not be responsible for any injuries, loss or damages of any kind (compensatory, direct, incidental, consequential or otherwise) with respect to, or in any way arising from, this Contest or the prizes awarded; and, lost, destroyed, damaged, misdirected, illegible, incomplete or late entries which will be void. Entry materials that have been tampered with, reproduced, falsified or altered are void. Any attempt to deliberately damage or to undermine the legitimate operation of this Contest is a violation of laws and may be subject to remedies and damages, including criminal prosecution. Contest Sponsors assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction to or unauthorized alteration of the entries. Contest Sponsors are not responsible for (i) any problems or technical malfunctions or any telephone network or lines, computer online systems, servers, or providers, computer equipment, software; (ii) the failure of any email or entry to be received by Contest Sponsors on account of technical problems or traffic congestion on the Internet or at any Web site; or (iii) any combination thereof, including any injury or related damage to participants or any other persons, whether computer-related or resulting from participation or downloading of any materials in this Contest. Any attempt to deliberately damage any Web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws, and should such an attempt be made, Contest Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, robotically generated, mutilated, forged, falsified, altered or tampered with in any way. In no event shall Contest Sponsors be held to award more prizes than what is mentioned in these rules or to award prizes otherwise than in compliance with these rules.
Consent to Use Personal Information: By entering the Contest and voluntarily providing certain personal information (including e-mail address, first name, last name, title, address, phone number, city, province, and postal code) (collectively “Registrant Information”) you consent to the collection and use of the Registrant Information by Land Rover Canada and the Contest Judges to administer this Contest. In addition, by checking the opt-in box on the entry form for this Contest, you expressly consent to: (i) Land Rover Canada’s use and disclosure of your Registrant Information in accordance with Land Rover Canada’s Privacy Policy, including to: improve its products and services; provide you with services, surveys or marketing material; and (ii) provide your Registrant Information to the Bank of Montreal, Bank of Nova Scotia and Financial Links, Nordica and your Jaguar and Land Rover retailer(s) or the Jaguar and Land Rover retailer who has responsibility for the market area in which you reside (collectively, the uses set out in (i) and (ii) above shall be referred to as the “Additional Uses”). Your consent to the Additional Uses by Land Rover Canada may be revoked at any time (without revoking your participation in the Contest or impairing your chances of winning). If you register by online entry to participate in the Contest, but have not opted to the Additional Uses, your Registrant Information will be collected and used by Land Rover Canada only to administer the Contest and for notifications as set out in these Contest rules and for no other purpose, unless otherwise required by law.
